1. Definitions
In these Terms: “Company,” “Seller,” “we,” “our,” or “us” means BenusBeauty, operating from Twelfth Street, Moons Palace Hotel, Shop B8, Nairobi, Kenya. “Customer,” “you,” or “your” means any individual or business purchasing Products from the Company or using the Website. “Website” means www.benusbeauty.com . “Products” or “Goods” means all items offered for sale by the Company. “Order” means a request submitted by a Customer to purchase Products in accordance with these Terms.
2. General
2.1 These Terms apply to all sales of Products whether made online via the Website or in-store. 2.2 By placing an Order, you agree to these Terms in full. If you do not accept them, you must not purchase from us. 2.3 No employee or agent of the Company is authorised to vary these Terms unless confirmed in writing by a director of the Company. 2.4 We may update these Terms from time to time. The version in force at the time you place your Order will apply to that transaction.
3. Price
3.1 Prices are quoted in Kenyan Shillings (KES) and include VAT or other applicable taxes unless stated otherwise. 3.2 Prices are subject to change without notice. Such changes will not affect Orders already confirmed. 3.3 We take care to ensure that all pricing information is accurate. If an error occurs, we will inform you promptly. You may then reconfirm your Order at the correct price or cancel for a full refund.
4. Payment
4.1 Payment is required in full when placing an Order. 4.2 Accepted payment methods include M-Pesa, Pesapal, debit cards, and credit cards. 4.3 We reserve the right to cancel any Order if payment is declined, reversed, or suspected to be fraudulent. 4.4 Payments are processed securely through third-party providers. We do not store or retain your card details.
5. Orders and Contract Formation
5.1 Your submission of an Order constitutes an offer to purchase Products under these Terms. 5.2 A contract is formed only once we confirm acceptance of your Order and dispatch the Products. 5.3 We reserve the right to refuse Orders in whole or in part, particularly in cases of unavailability, errors in pricing, or evidence of fraud.
6. Delivery and Shipping
6.1 We deliver nationwide within Kenya. 6.2 Nairobi deliveries are ordinarily completed within 1–2 business days. Deliveries outside Nairobi are ordinarily completed within 2–5 business days. 6.3 Delivery times are estimates only. We are not liable for delays caused by couriers, public holidays, strikes, or events beyond our control. 6.4 You must provide accurate and complete delivery details. We are not responsible for losses or delays resulting from incorrect information. 6.5 Delivery charges are shown at checkout before payment is confirmed.
7. Risk and Title
7.1 Risk of loss or damage to Products passes to you once delivery is made to the address you provided. 7.2 Legal ownership of Products passes only when full payment has been received by the Company.
8. Returns and Refunds
8.1 For hygiene and safety, Products that have been opened, used, or unsealed are not eligible for return. 8.2 Unopened Products in original condition may be returned within seven (7) days of delivery. Proof of purchase must be provided. 8.3 Refunds will be made to the original payment method within fourteen (14) business days after the returned Products are received and inspected. 8.4 Delivery charges are non-refundable unless the return is due to our error or defective Products.
9. Defects and Liability
9.1 If you believe Products are defective or not as described, you must notify us within seven (7) days of delivery. 9.2 Our liability is limited, at our discretion, to either replacement of the defective Products or refund of the purchase price. 9.3 Except as expressly stated, we exclude all warranties, whether express or implied, to the maximum extent permitted under Kenyan law. 9.4 Our total liability for any claim shall not exceed the amount paid for the specific Product giving rise to the claim.
10. Intellectual Property
10.1 All intellectual property rights in the Website and its contents, including text, images, product descriptions, and logos, remain the exclusive property of BenusBeauty. 10.2 You must not copy, reproduce, or use any content from the Website without our prior written consent.
11. Privacy
11.1 We collect and process personal data in line with our Privacy Policy, which is available on the Website. 11.2 By purchasing from us, you consent to our use of your personal data for order processing, delivery, and customer support.
12. Amendments
12.1 We may revise these Terms from time to time. 12.2 You are bound by the version published on the Website at the time you place your Order.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by the laws of Kenya. 13.2 Any dispute shall be subject to the exclusive jurisdiction of the courts of Kenya.
